Just like any other area of law, some specific situations are not foreseen and therefore have no clear legal answer. Faced with these grey areas, some argue that cultural heritage professionals have a duty to bear some risk in order to fulfill the public interset mission that they are publicly funded to deliver. How can risk be measured, and when is it too much?
