Stakeholder dialogues for out of commerce works

The 2019 Copyright in the Digital Single Market Directive created a legal possibility for cultural heritage institutions (CHIs) from across the European Union to be able to share out of commerce works.

While most European Union Member States have transposed the out of commerce works provisions, cultural heritage professionals and rightsholder representatives in the Europeana Network Association are experiencing challenges in practice that risk undermining the success of the new system.

These challenges could be easily addressed through the stakeholder dialogues, which the Directive calls to be set up in each member state.

Building upon the Recommendations of the Europeana Conference under the German Presidency, this online meeting will provide information about some of the uncertainty that remains in practice in the area of out of commerce works, how the stakeholder dialogues can help addressing these bottlenecks, and what a useful set up for these could be.
